The Tynado Foundation, Inc. (“Tynado Foundation”, “we,” “us,” or “our”) provides this Privacy Policy to inform Registered Users (as defined below) of our policies and procedures regarding the collection, use and disclosure of Personal Information (as defined below) received from registered users of this website, located at www.tynadofoundation.org (the "Site"). It is your responsibility to review this Privacy Policy carefully, especially before providing any Personal Information through the Site. This Privacy Policy is incorporated into, and part of, our Terms of Use which govern your access and use of this Site and the Content in general. Unless otherwise defined herein, capitalized terms shall have the meanings assigned to such terms in the Terms of Use. By accessing this Site and/or using the Services, you agree to the terms of this Privacy Policy.
 

1. INFORMATION WE COLLECT FROM YOU.

We collect your Personal Information via the Site only when you expressly provide it to us, namely, to track donations, inform you of upcoming events, and respond to your requests. "Personal Information" is information about you that is personally identifiable to you, like your name, title, place of employment, street address, email address, and office or mobile telephone number. In addition, to make a payment/donation to Tynado Foundation, we use a payment processing service called Clover that will require submission of credit card or bank information. By submitting Personal Information through the Site, you agree to the terms of this Privacy Policy and you expressly consent to the processing of your Personal Information according to this Privacy Policy.
 

2. INFORMATION WE TRACK.

As part of operating the Site and providing the Services to you, we automatically gather donor information in order to track donations, inform donors of upcoming event, and thank donors for donations. Services, and in certain cases, we may use this information to deny service in accordance with our Terms of Use.
 

3. HOW YOUR PERSONAL INFORMATION IS COLLECTED.

In order to access the Site and use the Services, you will be required to register as a user of the Site (each, a “Registered User) and to submit the following Personal Information to us as part of the registration process: your email address, a password you have created to access the Site, your first and last name, title, business name and address, and your primary telephone number. You may also elect, but are not required, to provide the following Personal Information during the registration process or after you become a Registered User: a secondary email address and/or telephone number. You can access, update and correct the Personal Information you provide to us via the Site at anytime by logging into your Registered User account.
 

4. HOW WE USE YOUR PERSONAL INFORMATION.

The Personal Information Tynado Foundation gathers from you or your employer may be used for the following purposes: (1) to accept donations you have made; (2) to inform you of upcoming events, (3) to thank you for your donation/participation/support. Please understand that if you choose not to receive promotional correspondence from us, we may still contact you in connection with your relationship, activities, transactions and communications with us. Any and all uses of Personal Information by Tynado Foundation comply with applicable laws.
 

5. HOW WE SHARE YOUR PERSONAL INFORMATION.

Except as otherwise expressly provided in this Privacy Policy, we will only share the Personal Information you provide us via the Site: (A) as required by law or regulation or as we believe in good faith that disclosure of such information is reasonably necessary to (1) satisfy any applicable law or regulation, (2) respond to claims and/or to comply with a judicial proceeding, court order, or legal process served on us, (3) to protect and defend our rights or property, and/or the rights or property of our Registered Users, or third parties, as permitted by law (4) detect, prevent, or otherwise address fraud, security or technical issues, or (5) enforce our Terms of Use; (B) with trusted service providers for the purpose of processing Personal Information on our behalf (e.g. Clover), to provide certain specialized products or services that you have requested, or to perform services to maintain and operate the Site and certain features on the Site (i.e., we may use third parties to host the Site; operate various features available on the Site; assist in responding to requests, or process credit card payments), which trusted services providers will process such information or use your information to provide the requested services in compliance with appropriate confidentiality and security measures.

We will attempt to contact a user about legal demands for their personal data when appropriate in our judgment unless prohibited by law or court order or when the request is an emergency.
 

6. USE OF ANONYMOUS INFORMATION.

We may create anonymous information records from your Personal Information by excluding information (such as your name, email address, phone) that makes the information personally identifiable to you. For clarity, anonymous information means information that cannot be used to personally identify an individual person. We may use this anonymous information for any purpose in our discretion, such as using your data to generate statistics about our customers, their profession or industry, to calculate ad impressions served or clicked on, or to publish visitor demographics for a Service.
 

7. CHILDREN UNDER 13 YEARS OF AGE.

You should be aware that this Site is not intended for, or designed to attract, children under the age of 13 and as such, Tynado Foundation does not intentionally gather Personal Information from individuals who are under the age of 13. If we become aware that a child under 13 has provided us with Personal Information, we will delete such information from our files.

Tynado Foundation’s provision of links to third party web sites on the Site is for your convenience and does not signify our endorsement of such other web sites or their content. Tynado Foundation has no control over, does not review, and cannot be responsible for these third-party web sites or their content. Please be aware that the terms of this Privacy Policy do not apply to these third-party web sites.
 

9. SECURITY.

Tynado Foundation uses reasonable measures to maintain the security of your Personal Information. We use industry standard SSL (secure socket layer) encryption whenever we ask you to login to the Site and when we display your Personal Information. However, no company, including Tynado Foundation can fully eliminate security risks associated with the transmission of Personal Information through online transactions, and you do so at your own risk.
 

10. NOTICE TO CALIFORNIA RESIDENTS.

California Civil Code Section 1798.83 permits customers who are California residents and who have provided E2Excel with "personal information" (as that term is defined in Section 1798.83) to request certain information about the disclosure of that information to third parties for their direct marketing purposes.
 

11. PRIVACY POLICY UPDATES.

This Privacy Policy may be updated from time to time for any reason; each version will apply to information collected while it was in place. We will notify you of any material changes to our Privacy Policy by posting the new Privacy Policy on our Site.
